Robert Morss

Morss and others attempted to push the fence which police were holding to separate them from the crowd. He said to officers: “You guys are betraying us. You get paid enough to betray your people.”

He held a yellow Gadsden flag as the crowd advanced toward the West Terrace archway. People there were subjected to police brutalities. Morss yelled into the crowd for protesters to pick up fallen shields and pass them towards the archway so people there could form a wall against police.

Please keep in mind that in the United States, every citizen charged with a crime is presumed innocent until proven guilty.

Assaulting, Resisting, or Impeding Certain Officers and Aiding and Abetting (10) Robbery and Aiding and Abetting (20) Assaulting, Resisting, or Impeding Certain Officers and Aiding and Abetting (27) Obstruction of an Official Proceeding and Aiding and Abetting (34) Civil Disorder (35) Disorderly and Disruptive Conduct in a Restricted Building or Grounds with a Deadly or Dangerous Weapon (41) Engaging in Physical Violence in a Restricted Building or Grounds with a Deadly or Dangerous Weapon (49) Disorderly Conduct in a Capitol Building (52) Act of Physical Violence in a Capitol Grounds or Buildings (53)

Case Status

Arrested 6/11/21. Ordered detained pretrial. Arraigned 6/30/21 and plead not guilty to all counts, and again on 12/17/21. During a bench trial on 8/23/22, he was found guilty of counts 20, 27, and 34 of the Fifth Superseding Indictment. Sentencing held on 5/24/2023, sentenced to a term of 66 months of Incarceration on each of Counts 20ss, 27ss, 34ss, with all terms to run concurrently, followed by a term of 24 Months of Supervised Release on each of Counts 20ss, 27ss, 34ss, with all terms to run concurrently. Special Assessment of $300 and Restitution in the amount of $2,000. Oral motion by the Government to dismiss all remaining counts, heard and granted.
