Dustin Byron Thompson

Dustin Thompson is charged with stealing a coat rack from the Capitol Building, and can be seen posing in a picture with said coat rack in his Statements of Facts.  Robert Lyon and Thompson both entered the Capitol, though any violence is not detailed in their documents.

Case Status

Arrested 1/25/21 in the Southern District of Ohio. He was released on personal recognizance on 1/28/21. Indicted 2/26/21 and arraigned 4/21/21 where he pleaded not guilty to counts 1,2,4,5,6, and 7 of the indictment. After a jury trial on 4/14/22, he was found guilty of all counts. Sentencing held on 11/18/2022 as to count 1s, sentenced to 36 months of incarceration, to run concurrently with all other counts; with credit for any served time the defendant may be entitled to receive credit for; and 36 months of supervised release. Special Assessment of $100.00 imposed. On each of Counts 2s, 3s, 4s: Defendant sentenced to Twelve (12) Months of incarceration, to run concurrently with all other counts, with credit for any served time the defendant may be entitled to receive credit for; and Twelve (12) Months of supervised release. Special Assessment of $25.00 imposed on each of Counts 2s, 3s, 4s. On each of Counts 5s, 6s: Defendant sentenced to Six (6) Months of incarceration, to run concurrently with all other counts, with credit for any served time the defendant may be entitled to receive credit for; No supervised release imposed; Special Assessment of $10.00 imposed on each of counts 5s, 6s. Restitution imposed in the amount of $2000.00. A Fine imposed in the amount of $200.00. Counts 1, 2, 4, 5, 6, 7, dismissed on oral motion by the government.
