Video footage shows Bingert was present at the Capitol on Jan. 6th. He and others in the crowd shoved a barrier into police officers and lifted it to break through the police line. After the crowd is tear gassed, he is seen with others waving an American flag and chanting.

Bingert was arrested on 1/18/21 after his lawyer contacted the FBI on his behalf and Bingert agreed to turn himself in. Conditions of release were set on 02/12/2021. Entered a plea of not guilty to all counts on 2/12/21 and on 8/5/21. During a bench trial on 5/24/23, Bingert was found guilty of counts 1, 2, 3, 4, 5, 6, and 8.
