Charles Bradford Smith and Marshall Neefe communicated via Facebook prior to Jan.6th. Smith expressed concern about the riots in 2020. He encouraged Neefe and others to travel to Washington to protect the city against rioters.
At the Capitol, Smith allegedly yelled for others in the crowd to force a door closed as police tried entering. He touched a sign that day, as did others.

Smith was arrested on 9/13. He appeared in court on 9/16. Smith was placed on Standard Conditions of Release/Home Confinement with Radio Frequency on 09/16/2021. On 6/23/22, he plead guilty to counts 1 and the lesser count of count 4. On 9/23/22, he was sentenced to 41 months in prison and 36 months probation. He was ordered to pay a $100 special assessment on each count and $2,000 restitution. The case was appealed on 10/7/22.
