Timothy Louis Hale-Cusanelli

The government recorded a conversation in which Hale admitted he was inside the Capitol. He says he encouraged the crowd and called for more people to join. Inside, he picked up a fallen American flag  so he could properly dispose of it.

The government indicates Hale shares his political viewpoints on YouTube. However, it has not documented in a public forum any violent acts he committed on Jan. 6th.

Obstruction of an Official Proceeding and Aiding and Abetting (1) Entering and Remaining in a Restricted Building or Grounds (2) Disorderly and Disruptive Conduct in a Restricted Building or Grounds (3) Disorderly Conduct in a Capitol Building (4) Parading, Demonstrating, or Picketing in a Capitol Building (5)

Case Status

Arrested 1/17/21. Arraigned on 3/23/21 where he plead not guilty on all counts. Ordered to remain in detained. Jury Deliberation held on 5/27/2022, on Count 1s, 2s, 3s, 4s, 5s. Jury verdict: guilty as to all counts. On 9/16/22, he was sentenced to 48 months in prison, followed by 36 months of supervised release. A $100 special assessment was imposed, along with a $170 assessment, and $2,000 restitution.
