Video surveillance shows DeGrave inside the Capitol on Jan. 6th. He entered the building to document the event for a podcast. DeGrave is accused of putting up his fists to box with a Capitol Police officer. There is no witness testimony in the indictment from a witness or victim saying that he assaulted the officer.
The government uses First Amendment commends DeGrave made on social media to allege his guilt.
