Matthew Council

Council allegedly pushed against a police barrier to open an emergency door that he and others in the crowd went through. He yelled at police and was pepper sprayed after pushing an officer.

Council apologized while in custody after he was read his Miranda rights. He said he did not intend to harm the officer.

Please keep in mind that in the United States, every citizen charged with a crime is presumed innocent until proven guilty.

Civil Disorder (1) Assaulting, Resisting, or Impeding Certain Officers (2) Entering and Remaining in a Restricted Building or Grounds (3) Disorderly and Disruptive Conduct in a Restricted Building or Grounds (4) Disorderly Conduct in a Capitol Building (5) Parading, Demonstrating, or Picketing in a Capitol Building (6)

Case Status

Arrested 1/14/21 in the Middle District of Florida. Initial Appearance 1/14/21 in the Middle District of Florida. Indicted 3/10. Arraigned 4/8 where he pleaded not guilty to all counts. He was released on personal recognizance bond. On 8/10, he plead guilty to counts 1-6. He was sentenced on 12/12/22 to 60 months probation, including 180 days of home incarceration with location monitoring. Council was ordered to pay $270 in a special assessment, $2,000 in restitution, and complete 100 hours of community service as approved by the probation office. Progress Hearing set for 2/23/2023 at 2:00 PM in Courtroom 2.
