Kyle Fitzsimons

In the archway headed into the Capitol, Fitzsimons allegedly charged the police line. However, he said he was protecting the doorway and “anyone sucked into the crowd was pushed into the police line and subjected to brutality.”

He was beaten by an officer who struck his head with a baton. The left side of his forehead began bleeding. Fitzsimons was attended to by a rescue squad and treated at a DC hospital.

Case Status

Arrested 2/4/21. Indicted 2/26. Oral Motion for release from custody denied on 4/7/21. Arraignment held 4/22. Kyle Fitzsimons filed a motion for change of venue as well as an appeal. Second superseding indictment issued 5/18/22. He plead not guilty to all charges. On 9/27/22, Judge Rudolph Contreras found Kyle Fitzsimons guilty as to counts 1-11 of this indictment. On 7/13/23, Kyle Fitzsimons was sentenced to 87 months in prison, followed by 3 years of probation. He was ordered to pay $770 in special assessments and restitution totaling $2,000.
