Joshua Matthew Black

Black was pictured inside the Senate Chamber, bleeding from his left cheek apparently from some sort of projectile that was shot at him.  Black admitted to having a knife, which explain the bulk of the charges the DOJ was able to include in his case.  Black stated, however, that the knife was under his clothes and he did not take it out to use it.  He was not charged with any violence.

Obstruction of an Official Proceeding and Aiding and Abetting (1) Entering and Remaining in a Restricted Building or Grounds with a Deadly or Dangerous Weapon (2) Disorderly and Disruptive Conduct in a Restricted Building or Grounds with a Deadly or Dangerous Weapon (3) Unlawful Possession of a Dangerous Weapon on Capitol Grounds or Buildings (4) Entering and Remaining on the Floor of Congress (5) Disorderly Conduct in a Capitol Building (6)

Case Status

Arrested 1/14/22. Initial appearance 2/16/21. Black remains on personal recognizance. Indicted 2/17/21 and arraigned 3/19/21 where he pleaded not guilty to all counts. Motions hearing held on 4/22/21. Status conferences held on 5/4, 7/7, and 9/10, 2/10/22, 3/18/22, and 4/28/22. Defense received extra time to file pretrial motions. 12/7/22 superseding indictment filed. On 12/20, Black plead not guilty to all charges. After a bench trial, he was found guilty on 1/13/23 of counts 2, 3, 4, 5, and 6. On 5/16/23, Black was sentenced to 20 months incarceration, with credit for time served. He was also ordered to complete 24 months of probation and pay a total of $320 in special assessments and restitution in the amount of $2,000.
