Joseph Lino Padilla

Padilla attempted to push through police barricade and was beaten by police. He moved away and helped others use a large wheeled sign as a battering ram against police. He allegedly threw a flag pole at police as the situation escalated.

He wrote on social media: “as a first-hand observer or every point of last night, that it was not Antifa. They were Patriots who were trying to restore the Republic after being attacked by cops, and who struck first.”

Please keep in mind that in the United States, every citizen charged with a crime is presumed innocent until proven guilty.

Case Status

Padilla was arrested on 2/23/21. Indicted 3/12/21. Padilla plead not guilty on all counts on 3/30/21. He has been held without bond. Second superseding indictment issued 4/12/23. On 5/1/23, he plead not guilty to all counts. During a bench trial on 5/3, he was found guilty of all charges except for count 2. On 9/13/23, he was sentenced to 78 months in prison, with credit for time served. In addition, he was ordered to 24 months of probation, payment of $820 in special assessments and restitution in the amount of $820. Restitution shall be paid in equal monthly installments of $100 over a period of 20 months, starting 9/13/23. An appeal of the final judgment was made on 9/27/23.
