Hernandez entered the Capitol carrying an American flag. He moved with the crowd through the Senate wing, Crypt, Speaker’s Lobby, Speaker’s conference room, and Rotunda. In the East Rotunda, he is accused of hitting an officer with a flagpole.

Case Status

Hernandez was arrested on 2/23/22 and appeared in court on 3/8. He plead not guilty to all charges. Hernandez plead guilty to counts 1 and 3 on 11/2/22. His sentencing is scheduled for 2/2/23 at 10am in Courtroom 27A.
