Capitol surveillance shows Nix entering the building, speaking on a cell phone. He is accused of attempting to open the East House doors by banging a flagpole against them. In addition, he is accused of engaging a Capitol Police officer standing near the area. He allegedly brought a black baton with him inside of the Capitol.

Nix was arrested on 11/10/21. On 11/23, he appeared in court and pleaded not guilty to all charges. Nix was released on personal recognizance. On 12/16/22, he plead guilty to count 2. On 6/2/23, he was sentenced to 42 months of incarceration followed by 24 months of supervised release. He was ordered to pay a $100 special assessment and restitution in the amount of $2,000. Nix was permitted self-surrender.
