Benjamin Henry Torre

Torre admitted that he entered the U.S. Capitol by climbing through a broken window.  He stated the window had already been broken.  According to Torre, officers “helped us in Capitol”, and they did not try to stop them from coming in nor did they make them leave.  According to his Statement of Facts, he remained peaceful inside the Capitol and while trying to exit out of the same broken window he entered through, a Capitol Police officer advised going out the door to avoid injury.

Arrested 2/9/21 and made his initial appearance the same day. Charged via information on 2/22 and arraigned 3/3 where he pleaded not guilty to all counts. On 03/04/2021, he was released on personal recognizance. Plea Agreement Hearing held on 3/9/2022, he entered a plea of guilty to Count 5 of the Information (doc #8). Sentencing held on 7/7/2022, sentenced to 12 months of Probation and 2 months of home confinement with conditions. Special Assessment: $10.00; Restitution: $500.00; Fine: $1,113.00. Open counts 1, 2, 3 and 4 dismissed on the Government's Motion
