Creek was seen outside the Capitol and is accused of striking an officer near the fence line. He went to a local hospital several days later, stating he was tear gassed by police. He told the staff “he was gassed before in the military [but] never experienced the types of effects he was experiencing.”
Creek also made a verbal statement about being inside the building. However, the DOJ criminal complaint does not show footage of Creek inside.

On 5/2/22, Creek was sentenced to 27 months of incarceration, 12 months of supervised release, a $100 special assessment and $2,000.00 restitution.
